Breeding Contract for PFC Trevallon AHR #579363

1. Stud fee: The stud fee for Arabian mares for the 2008 breeding season is $1,500. A NON-REFUNDABLE booking fee of $500 is due at the time this contract is signed.  The remainder of the stud fee is due before the first semen shipment is made or the first cover. The breeding fee is non-refundable. Non Arabian mares may be bred for an $800 stud fee, the $500 booking fee is due at signing of the contract.

2. Method of breeding: Mares may be bred using transported semen or live cover if the mare is brought to Birch Park Black Arabians for service. If breeding by live cover is desired, arrangements must be made with Birch Park Black Arabians in advance.  This option will only be available as time and space permit.  All vet bills in preparation for live cover are the responsibility of the mare owner.  

3. Transported Semen:  Prior to any shipment, the collection fee of $325 and the Equitainer deposit of $250 must be recieved.  If the Equitainer is returned intact and in same condition when shipped to you, the deposit will be returned.  The cost of any missing Equitainer parts will be added to your account.  Equitainers must be shipped at your expense to arrive at Birch Park Black Arabians within five days of your receipt of the Equitainer.  A late charge of $20 per day will be added to your account if the Equitainer is late.

A shipment will contain two packets of semen whenever possible.  If additional shipments are necessary, an additional $325 fee must be received PRIOR to each shipment.  The Equitainer deposit will be rolled over assuming the first Equitainer is returned intact and on time. Shipments will be made on Monday, Wednesday and Friday of each week during the breeding season.  Notice must be given to Birch Park Black Arabians by noon of the day prior to the day shipping is requested.  Shipment to you will be by Federal Express Priority Overnight AT YOUR EXPENSE AT THE ACTUAL COST OF SHIPPING.  Shipping costs from FedEx have jumped. Same day delivery is not available.

Please notify Birch Park Black Arabians of the approximate date you plan to breed your mare.  We encourage you to have your mare examined by a veterinarian on the cycle prior to the planned breeding.   Please call Birch Park Black Arabians at 541-536-5865 by noon the day prior to the day you desire shipping (TWO days before you need to inseminate!).  Although we will make all reasonable efforts to meet your needs, our schedule and other shipment commitments may make it impossible to ship when you request.

4.   Live foal guarantee: A live foal is any foal that is able to stand and nurse.  A claim of no live foal must be made in writing no later than 48 hours after delivery or no later than 30 days after the mare was due and must be accompanied by a veterinarian's explanation in writing. This guarantee is subject to vet approved prenatal vaccination program.  If the mare does not deliver a live foal, the mare, or a suitable replacement may be bred the following season.  A rebreeding fee of $200 will be charged. Should the stallion be sold or die, this guarantee will be null and void.

5. Disputes:  This agreement constitutes the entire agreement of the two parties, no oral agreement shall modify it in any manner.  The terms of this agreement shall only be modified by written agreement signed by both parties or changes initialed by both parties. Signer represents that s/he is the owner/lessee of the below named mare and agrees to indemnify, defend and hold harmless the stallion owner s and/or Birch Park Black Arabians in the event the ownership or authorization of the below signed customer is disputed.  Any unpaid balance more than 30 days old will accrue interest at 1.5% interest per month.  Visa or MasterCard accepted.
